Terms and Conditions

EVENT CONFIRMATION - Your Event will be confirmed only upon receipt of your non-refundable deposit equal to fifty percent (50%) of the Estimated Event Cost as set forth in this Agreement and a signed Event Agreement. Your deposit may be paid by credit card or bank transfer. All box and space rentals, food and beverage are subject to applicable tax. Food, beverage and select rentals are subject to a discretionary 12.5% service charge.

FINAL GUEST COUNT - All Events require a minimum of 1x box with a minimum of 12 guests unless booked onto a minimum spend package. Your final guest count and guest list must be confirmed with the Event Coordinator at least 14 days prior to the Event. Your expected (planned) guest count may only be reduced by 20%, if submitted more than 14 days prior to the Event. Guest counts cannot be reduced below the 12 guests which is the minimum required for Events unless booked onto a minimum spend package. No guest count decreases will be accepted after the 14-day deadline. After the 14-day deadline, we are unable to accept any name changes. Should your guest count increase within 72 hours of the Event or additional guests attend on the day of the Event without prior notice, TOCA Social will accommodate your additional guests if possible, based on availability. If additional guests arrive on the day of the Event, further approval is required and your additional guests may be turned away- this is in the circumstance that we are at our Box capacity, or if your additional group members are under 18 after 6pm. Please also note that anyone who appears under the age of 25 is subject to an ID check, should the person fail to produce ID when requested they may be turned away from the venue.

FINAL PAYMENT - Final payment equal to the Estimated Total Event Cost as set forth in this Event Agreement less the deposit paid is due in full fourteen (14) business days prior to your event. TOCA Social accepts company checks payable to TOCA Social (if pre-approved by TOCA Social), MasterCard, Visa or via our online portal. If final payment is not received within fourteen (14) business days prior to your Event, TOCA Social reserve the right to cancel the Event and retain your deposit. Please note we are a cashless venue.

CARD AUTHORISATION - Should you wish to add a authorise Credit/Debit Card to the Triple Seat guest portal this is completed at your discretion for future payments for the event booking date. TOCA Social does not have access to view full card details and will only be held within Triple Seat (a third-party platform).

FOOD & BEVERAGE - Only food and beverage purchased at TOCA Social may be consumed on-site. In the event that the Client has booked a minimum spend package if you do not reach the contracted amount, the Event Booker (Client) will be responsible for the payment of the difference left to reach the contracted total.

Buffet quantities are prepared and served based on the final guest count provided fourteen (14) days prior to the Event. Unused drink tokens are non-refundable. TOCA Social is unable to guarantee any changes to the Event Agreement, including but not limited to, the Event itinerary, and food or beverage options within (14) days prior to the Event.

EVENT TIME & DURATION - All Events are a minimum of two (2) hours unless booked onto a junior party where the duration of the event is 1.5 hours. The Event shall begin promptly at the contracted start time and the Event space shall be vacated by the Client at the contracted end time in this Agreement. TOCA Social will hold your box reservation for 15 minutes past the contracted reservation time. Should no guests arrive within this time without prior notification, TOCA Social reserves the right to release the boxes. Box rental and Event space time will not be extended if Event guests arrive late. Additional fees will apply if we are able to accommodate an extension on Event time. Extension of the box reservation, food, and beverage is subject to space availability and the Client will be responsible for any additional charges. Specific boxes are not guaranteed unless otherwise noted on the Event Agreement for groups that purchase the rental of an Event room where TOCA Social will provide the most convenient Boxes available.

EVENT REFUND, CANCELLATION/RESCHEDULE POLICY - If the Event is cancelled the deposit paid is non-refundable, and if you decide to reschedule more than fourteen (14) days prior to the Event, then your Event deposit can be applied toward a future Event date within six (6) months of the originally scheduled date. Any deposit not used within six (6) months of the original Event date will be forfeited by Client and retained by TOCA Social. If the Event is cancelled or rescheduled less than fourteen (14) days prior to the Event the Client is responsible for the contracted Event Agreement amount and any applicable catering minimums that the client has booked for. This cancellation policy remains in effect regardless of the weather on the day of the scheduled Event as TOCA Social is an indoor venue and can be played regardless of the weather conditions, except for any force majeure event (defined below). If you decide to reschedule, the above conditions may apply based on the re-rental of Event space and/or boxes previously reserved by the client and any additional costs incurred. TOCA Social reserves the right to refuse admission and cancel your event at any time should the behaviour of a guest be deemed inappropriate by TOCA Social.

FORCE MAJEURE - The parties of this Event Agreement will be excused from the performance of this Event Agreement to the extent that such performance is prevented by any act of God or force majeure. For the purposes of this Event Agreement, the terms act of God or force majeure include strikes, lockouts, sit-downs, material or labour restrictions by any governmental authority, unusual transportation delays, riots, hurricanes, floods, washouts, explosions, earthquakes, fire, storms, acts of the public enemy, wars, insurrections and/or any other cause outside the reasonable control of either party. If the Event performance is excused due to a foregoing force majeure event, the Client will be able to apply the full deposit toward a rescheduled Event or the deposit shall be refunded in full. TOCA Social and the Client hereby waive any claim from damages or compensation should this Event Agreement be terminated by an act of force majeure.

COVID-19 - Both parties confirm that they have taken COVID-19 and its impact into account in making business plans and made multiple, redundant supply arrangements to ensure that COVID-19 will not impair performance. In the event of a local or national lockdown preventing the contracted event from proceeding, or a member of the party contracting COVID-19 within 10 days of the event, it will be at the discretion of TOCA Social to advise if the client will be able to apply the full deposit toward a rescheduled Event taking place within six (6) months from the contracted Event date.

ALCOHOLIC BEVERAGES - TOCA Social reserves the right to inspect the identification of any person. TOCA Social will fully comply with all alcoholic beverage control laws including, without limitation: (i) requesting proper legal identification of any person of questionable age; (ii) refusing service of any alcoholic beverages to any person or persons who are underage or cannot produce, upon request, proper identification (driver’s license or passport), under TOCA Social’s sole and absolute discretion; and (iii) refusing service of any alcoholic beverage to any person(s), who, in the sole and absolute discretions of TOCA Social appears to be intoxicated or under the influence of a mind-altering substance. If minors attending the Event are observed consuming alcoholic beverages on the Facility premises, TOCA Social in its sole and absolute discretion shall have the right to immediately terminate the Event without any further obligation to the Client or any of the guests of the Event.

USE OF TOCA NAME/LOGO/IMAGES - All promotional and display materials relating to the Event that refer to or depict the Facility or the Toca Social name/logo shall be subject to Toca Social’s written approval prior to the production and dissemination. The client may not use nor display any names, symbols, logos, trade names or trademarks owned by (or identified with) any third party in connection with the Event without the prior written approval of TOCA Social. The client has no rights or interest in any intellectual property owned or licensed by TOCA Social.

PERSONAL PROPERTY - The client assumes all risk and responsibility for any personal property and/or equipment brought into the Facility in connection with the Event that may be damaged, lost, stolen or left at the Facility before, during, or after the Event, and will not hold TOCA responsible for any such loss or damage. TOCA Social will not accept deliveries to store Event items unless the Client has obtained prior written approval from the TOCA Social Events Manager at least seven (7) days prior to the Event. All items are shipped at the Client’s own risk.

DECORATIONS, ADVERTISING & ENTERTAINMENT - All decorations, advertising and outside contracted entertainment including Client signs and banners must be arranged with and approved by the TOCA Social’s Event Department at least seven (7) business days prior to your Event. TOCA Social reserves the right to limit and/or restrict any banners or other signage containing company logos.

SAFETY & RESPONSIBILITY - All patrons of the Event must adhere to the safety rules and regulations stipulated by TOCA Social. If an injury should result because safety rules are not followed or are ignored, TOCA Social will not be liable. Throughout the duration of the Event, all children under 16 must be supervised by an adult. If an injury should result due to lack of supervision, TOCA Social will not be liable.

BOOT ROOM - Our boot room can be used for your event and store all guest possessions, however, it is to be noted that all belongings are left at the clients' risk. Whilst TOCA Social will ensure this cloakroom is manned at all times, TOCA Social is not responsible or liable for items which go missing.

INDEMNIFICATION - Each party agrees to indemnify, defend and hold harmless the other party, its affiliates, agents, representatives, directors, officers, and employees from and against any and all claims (including but not limited to third party claims), suits, fees, losses, liabilities, damages, judgments, costs and expenses (collectively referred to as “Claims”), including reasonable attorney fees incurred as a result of such Claims, arising out of the actions of the indemnifying party pursuant to this Agreement, including but not limited to (a) the indemnifying party’s gross negligence or wilful misconduct in the performance or non-performance of this Event Agreement, (b) breach of any representation, warranty, or other obligation under this Event Agreement, or (c) any personal injury (including death) or damage to property resulting from the indemnifying party or its employees, invitees’, or guests’ acts or omissions.

APPLICABLE LAW - This Event Agreement shall be governed by English law and each party irrevocably submits themselves to the jurisdiction of the English Courts.

For purposes of these Terms and Conditions, the term “Event Agreement” when used herein shall mean the Toca Social Event Agreement together with these terms and conditions.

The signatory below is either the Client or one authorised to enter into this Event Agreement on behalf of the Client.
